URGENT TREATMENT 

THIS SERVICE IS NOT APPROPRIATE FOR TREATMENT IN AN EMERGENCY OR LIFE- THREATENING SITUATION – FOR EXAMPLE ORAL OR FACIAL SWELLING, SEVERE ORAL OR DENTAL PAIN, DENTAL TRAUMA, TRISMUS, A DENTAL OR ORAL PROBLEM THAT MIGHT AFFECT A MEDICAL CONDITION, SUSPECTED ORAL CANCER, PERISISTENT BLEEDING, SEVERE FACIAL SWELLING, SEVERE DENTAL TRAUMA. IF YOU BELIEVE THAT YOU, OR ANY PERSON YOU ARE ASSISTING, NEEDS URGENT OR EMERGENCY TREATMENT YOU SHOULD IMMEDIATELY DIAL 999 OR SEEK ALTERNATIVE EMERGENCY MEDICAL SERVICES. 

 

Who we are and how to contact us  

www.practihealth.co.uk is a Platform operated by Practi ("We", “Us”, “Our”). We are registered in England and Wales under company number 14143480 and have our registered office at Hambleden House, Waterloo Court, Andover, Hampshire, SP10 1LQ. 

For any matters concerning this Platform, please email: support@practihealth.co.uk. For all other matters please speak with your Dentist. 

 

Definitions and interpretations 

  • Dentist refers to Your registered dental practitioner responsible for providing the Services to You, and whose Dental practice policies you have agreed to separately and provided your consent where necessary. Your dentist must be registered with the General Dental Council and practise in a Care Quality Commission registered practice. 
  • Services refers to any medical or healthcare advice and/or dental treatments which are provided by Your Dentist. 
  • Special Categories of Personal Data refers to information revealing racial or ethnic origin, political opinions, religious or similar beliefs, trade union membership, physical or mental health conditions, sexual life, sexual orientation, biometric or genetic data. 
  • Terms refers to these terms and conditions. 
  • You, Your, Yours and Yourself refer to You. 

 

By using our Platform you accept these Terms 

When You access Our website (the “Platform”), You confirm that You accept these Terms and that You agree to comply with them. 

Additionally, You confirm that You will abide by your Dentist’s practice policies and have completed any necessary consent forms requested by Your Dentist in order to use the Services. Where You have not signed up to these, We reserve the right to revoke Your use of this Platform. 

 

If You do not agree to these Terms, You must not use Our Platform.Purpose of this Platform 

The purpose of this Platform is to enable You to access information in relation to dental treatments which will be provided by Your Dentist subject to these Terms and all other terms and conditions which apply to Your use of the Platform. 

 

There are other terms that may apply to You 

These Terms of use refer to the following additional terms, which also apply to Your use of our Platform: 

  • Our Privacy Policy - See further under How we may use Your personal information
  • Our Acceptable Use Restrictions which set out the permitted uses and prohibited uses of our Platform. When using our Platform, You must comply with the Acceptable Use Restrictions

 

We may make changes to these Terms 

We amend these Terms from time to time. Every time You wish to use our Platform, please check these Terms to ensure You understand the Terms that apply at that time. 

 

We may suspend or withdraw Our Platform 

We do not guarantee that Our Platform, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Platform for business and operational reasons. We will try to give You reasonable notice of any suspension or withdrawal. 

You are also responsible for ensuring that all persons who access Our Platform through Your internet connection are aware of these Terms and other applicable terms and conditions, and that they comply with them. 

 

We may transfer this agreement to someone else 

We may transfer Our rights and obligations under these Terms to another organisation. We will always tell You in writing if this happens and we will ensure that the transfer will not affect Your rights under the contract. 

 

Our Platform is only for users in the UK and Jersey 

The Platform may only be used by users aged 18 or above, who live in the United Kingdom, and who have clicked on the “I confirm” button on the sign-up page to signify that they have accepted these Terms and agree to be bound by them. 

 We do not represent that content available on or through Our Platform is appropriate for use or available in other locations. 

 

You must keep Your account details safe 

If You choose, or You are provided with, a user identification code, password or any other piece of information as part of Our security procedures, You must treat such information as confidential. You must not disclose it to any third party. 

We have the right to disable any user identification code or password, whether chosen by You or allocated by Us, at any time, if in Our reasonable opinion You have failed to comply with any of the provisions of these Terms. 

If You know or suspect that anyone other than You knows Your user identification code or password, You must promptly notify us at support@practihealth.co.uk

 

How You may use material on Our Platform 

 We are the owner or the licensee of all intellectual property rights in Our Platform, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. 

 You may print off one copy, and may download extracts, of any page(s) from Our Platform for Your personal use only. 

You must not modify the paper or digital copies of any materials You have printed off or downloaded in any way, and You must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. 

Our status (and that of any identified contributors) as the authors of content on 3Our Platform must always be acknowledged (except where the content is user-generated). 

You must not use any part of the content on Our Platform for commercial purposes. 

 If You print off, copy, download, share or repost any part of Our Platform in breach of these Terms, Your right to use our Platform will cease immediately and You must, at our option, return or destroy any copies of the materials You have made. 

 

No text or data mining, or web scraping 

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to Our Platform or any Services provided via, or in relation to, Our Platform. This includes using (or permitting, authorising or attempting the use of): 

  • Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the Platform or any data, content, information or Services accessed via the same. 
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations. 

 The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790). 

This clause shall not apply insofar as (but only to the extent that) We are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to Us. 

This Platform, its content and any Services provided in relation to the same are only targeted to, and intended for use by, individuals located in the UK (the “Permitted Territory”). By 

continuing to access, view or make use of this Platform and any related content and Services, You hereby warrant and represent to Us that You are located in a Permitted Territory. If You are not located in a Permitted Territory, You must immediately discontinue use of this Platform and any related content and Services. 

 

Do not rely on information on this Platform 

The content and resources provided on Our Platform is provided for general information purposes only on an ”as is and as available” basis and not advice or guarantee of outcome. It is not intended to amount to medical or dental diagnosis, advice, or treatment on which You should rely and should not be substituted for professional dental advice or treatment of your Dentist or other qualified healthcare professional. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on Our Platform. 

Although we make reasonable efforts to update the information on our Platform, We make no representations, warranties or guarantees, whether express or implied, that the content on our Platform is accurate, complete or up to date. 

Practi provides this Platform in order to allow You to view information including dental and healthcare information about the Services. You nor any other individual should use the information contained to self-diagnose or self-treat any health related condition. 

All of the material provided on this website such as text, possible outcomes, charts, graphics images, videos and other material are for informational purposes only. This Platform is not designed to provide medical or dental diagnosis, advice, or treatment and the material on it is not a substitute for professional dental advice and treatment from your dentist and practice team. 

The content of this website is for informational purposes only, not advice or guarantee of outcome. Information is gathered and shared from reputable sources; however, Practi: 

  1. is not responsible for errors or omissions in explanation; 
  2. provides no warranty as to the accuracy of the information; and 
  3. will not accept liability for any errors and/or omissions. 

No individuals should use the information contained to self-diagnose or self-treat any health- related condition. All individuals should always consult with their dental team for advice or information about their treatment and/or undertake the responsibility for assessing the accuracy of its content and shall rely on it entirely at their own risk if they choose to do so. 

 

Your payment obligations 

You agree to pay any fees and/or charges incurred by You in respect of the Services, in accordance with Your Dentist’s practice policies and any other terms which apply. 

We are not responsible for websites we link to 

Where Our Platform contains links to other websites, platforms and resources provided by third parties, these links are provided for Your information only. Such links should not be interpreted as approval by Us of those linked websites or information You may obtain from them. 

We have no control over the contents of those websites or resources. 

Access, correction, and data integrity 

Although We attempt to ensure the integrity and accurateness of the Platform, We make no guarantees as to its correctness or accuracy. It is possible that this Platform contains typographical errors, inaccuracies, or other errors, and that unauthorised additions, deletions, and alterations could be made to the Platform by third parties. In the event that an inaccuracy arises, please inform us by emailing support@practihealth.co.uk so that it can be corrected. 

 Our responsibility for loss or damage suffered by You 

Please note that We only provide Our Platform for domestic and private use. You agree not to use Our Platform for any commercial or business purposes, and We have no liability to You for any loss of profit, loss of business, business interruption, or loss of business opportunity. We will not be liable to You in respect of the Platform and its usage, including any loss or damage suffered pertaining to dental or healthcare advice and/or dental treatments received which are provided by Your Dentist and which are subject to their Dental practice policies. 

You expressly agree and acknowledge that the Services are exclusively provided by Your Dentist and not Practi. 

You expressly agree that Practi is not providing, and does not provide, dental or healthcare advice and/or dental treatments. 

The provision of the Platform, and the provision of information and/or Services You receive from Your Dentist via the Platform does not, in whole or in part, constitute or create a doctor- patient, therapist-patient or other healthcare professional relationship between Practi and You. 

Commentary and other material posted on the Platform is not intended to amount to advice on the part of Practi on which reliance can be placed and Practi disclaims all liability and responsibility arising from any reliance placed on such materials by any user of the Platform or by anyone who may be informed of its contents. 

If defective digital content that we have supplied, damages a device or digital content belonging to You and this is caused by Our failure to use reasonable care and skill, we will either repair the damage or pay You compensation. However, we will not be liable for damage that You could have avoided by following our advice to apply an update offered to You free of charge or for damage that was caused by You failing to correctly follow installation instructions or to have in place the minimum system requirements advised by Us. 

Practi will not be liable if for any reason Our Platform is unavailable at any time for any reason. 

 

How we may use Your personal information 

We will only use Your personal information as set out in our Privacy Policy. In particular, Practi may use information about You for the following: 

  1. To register you as a customer 
  2. To deliver our service to you 

You acknowledge that we may process the following types of Special Categories of Personal Data as part of your use of the Platform: 

  1. Data concerning a natural person's physical or mental health or condition 

 

We are not responsible for viruses and You must not introduce them 

We do not guarantee that Our Platform will be secure or free from bugs or viruses. 

You are responsible for configuring Your information technology, computer programmes and Platform to access our Platform. You should use Your own virus protection software. 

You must not misuse Our Platform by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Platform, the server on which Our Platform is stored or any server, computer or database connected to Our Platform. You must not attack Our Platform via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co- operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use Our Platform will cease immediately. 

 

Acceptable Use Restrictions 

You must not:  

(a) use this Platform, or any tools offered through this Platform, in a manner which; or (b) upload, post, transmit or otherwise make available through this Platform any material which: 

  1. violates or infringes the rights of others (including their intellectual property or privacy rights) including by the submission of any material (to the extent that such use is not licensed by these Terms); 
  2. is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, profane or which may harass or cause distress or inconvenience to, or incite hatred of, any person; 
  3. is defamatory, offensive or otherwise objectionable in relation to your use of the Platform; 
  4. encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law; 
  5. restricts or inhibits any other user from using or enjoying this Platform; 
  6. decompiles or reverse engineers any part of this Platform; 
  7. affects the functionality or operation of this Platform or its servers or the functionality or operation of any user’s computer systems (for example, by transmitting a computer virus or other harmful component, knowingly or otherwise) that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; or 
  8. breaches any standards, content requirements or codes promulgated by any relevant authority, including authorities which require us to take remedial action under any applicable industry code. 

Disclaimer about others' materials 

You acknowledge that any third-party materials appearing on this Platform are not necessarily controlled or monitored by Us and that the views expressed are not necessarily Ours. 

 

Termination 

You may end Your contractual relationship with Us at any time by unsubscribing to these Terms, ceasing Use of this Platform and destroying all materials obtained from this Platform, all related documentation and all copies and installations thereof, whether made under these Terms or not. 

We may end Your rights to access and use the Platform at any time by contacting You if You have broken any of these Terms (or any other applicable terms relating to Your access and use of the Platform and/or Services). If practicable We will give You a reasonable opportunity to put right any breach by You. 

Your rights to access and use the Platform are contingent upon your Dentist’s subscription to the Practi Platform. In the event that your Dentist’s subscription is terminated or cancelled (for whatever reason), we will end Your rights to access and use the Platform immediately.  

If We end Your rights to access and use the Platform You must stop Your use of the Platform and all activities authorised by these Terms. 

 

Which country’s laws apply to any disputes? 

These Terms, their subject matter and their formation, are governed by English law. You and We both agree that the courts of England and Wales will have exclusive jurisdiction except that if You are a resident of Northern Ireland, You may also bring proceedings in Northern Ireland, and if You are resident of Scotland, You may also bring proceedings in Scotland. 

 

Our trademarks 

You are not permitted to use our name or logo without our approval, unless they are part of material You are using as permitted under How You may use material on our Platform.
